1. Agreement to Terms

By accessing or using Kreggscode automation (the "Application"), you agree to be bound by these Terms of Service ("Terms") and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this Application.

We reserve the right to modify these terms at any time without prior notice. Your continued use of the Application following any changes constitutes your acceptance of the new Terms.

2. License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Application for your personal, non-commercial purposes.

3. User Responsibilities

3.1 Account Requirements

To use the Application, you must:

• Have a valid Google/YouTube account
• Grant OAuth authorization for the Application to access your YouTube account
• Be at least 13 years of age (or the minimum age of digital consent in your jurisdiction)

3.2 Prohibited Uses

You agree NOT to use the Application to:

• Upload content that violates YouTube's Community Guidelines
• Upload copyrighted material without proper authorization
• Upload spam, misleading metadata, or deceptive content
• Upload content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
• Use the Application for any automated bulk uploading that violates YouTube's terms
• Attempt to gain unauthorized access to the Application or its systems
• Reverse engineer, decompile, or disassemble the Application
• Redistribute, sell, or commercialize the Application without our express permission

4. YouTube API Services

The Application uses YouTube API Services to provide video upload functionality. By using this Application, you agree to comply with:

• YouTube Terms of Service
• YouTube Community Guidelines

You acknowledge that Kreggscode automation is not affiliated with, endorsed by, or sponsored by YouTube or Google Inc.

5. Intellectual Property

The Application and its original content, features, and functionality are owned by us and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You retain all rights to the content you upload through the Application. However, you grant us a limited license to process and transmit your content solely for the purpose of providing the Application's services.

6. Privacy

Your use of the Application is also governed by our Privacy Policy. By using the Application, you consent to the collection, use, and disclosure of your information as described in the Privacy Policy.

7. Disclaimers

7.1 No Warranty

THE APPLICATION IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

7.2 No Guarantee of Service

We do not guarantee that the Application will:

• Be available at all times or uninterrupted
• Be secure or error-free
• Meet your specific requirements
• Produce specific results (such as video views, subscribers, or revenue)

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR REVENUE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APPLICATION.

Our total liability for any claim arising from these Terms or your use of the Application shall not exceed the amount you paid to use the Application, if any.

9. Indemnification

You agree to indemnify, defend, and hold harmless Kreggscode automation and its owners, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

• Your violation of these Terms
• Your use of the Application
• Your violation of any third-party rights, including YouTube's terms
• Your violation of any law
• Content you upload through the Application

10. Termination

We may terminate or suspend your access to the Application at any time, with or without cause, with or without notice, effective immediately. Upon termination, your license to use the Application will immediately cease.

All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

11. Third-Party Links

The Application may contain links to third-party websites or services that are not owned or controlled by us. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where we operate, without regard to its conflict of law provisions.

13. Dispute Resolution

Any disputes arising out of or relating to these Terms or the Application shall first be attempted to be resolved through good faith negotiations. If such negotiations fail, the dispute shall be resolved through binding arbitration in accordance with applicable arbitration rules.

14. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to reflect the original intent as closely as possible.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Kreggscode automation regarding your use of the Application and supersede all prior agreements and understandings.
